Well, at that point, i would say using a gun was justified. The problem was everything that led to that point. The security guard probably didn't receive proper training and didn't know where his responsibilities end. He should have called the cops and stayed out of it. Easier for him anyways. This is gonna be a 50/50 case. The customer had to leave and should have left when asked, the guard did his job, but went too far when hitting the guy with a baton. Once the customer went on the offence and punched the guard in the head, the situation reversed and the guard went on defense and could make a case for self defense. |

Doesn't matter how the situation materialized. The guard had a gun and other dude brought fists to a gun fight. Mistakes were made. This is how the gene pool is cleansed. You pick the wrong fight, you die.

. Absolutely!! Fairly certain this Sec. Officer will be charged in this shooting…. 17 yrs in Law Enforcement for me!! Once the victim released the baton, and appeared to calm down, this should have been over. The security officer escalated this far beyond a point that it should have gone!!!! Guilty of 1st degree murder in my opinion!!

When the guard re-escalated by striking a retreating subject, he could no longer claim self-defense for the shooting. Shouldn't have slept through that CCW class.

So customer had a weapon - a baton - and security guard has a gun. Security guard already has advantage. Security guard disarms the customer so now customer is totally unarmed and guard has two weapons. Customer has disengaged and is walking away. Guard uses newly obtained second weapon to hit unarmed customer as he’s mad and wants to assert his dominance. Situation escalates again and customer gets shot. Totally guard’s fault. That was entirely avoidable |
