So basically he didn't like the guy putting the mattress into the dumpster like he was suppose to so he took it belligerently upon himself to remove it. The father and son shroud be charged but really, that dead asshole was the major instigator and orchestrator of his own death. Good riddance moron.

They're arguing "Stand Your Ground" law as a defense. I think they've got enough of a defense in that regard to get it down to manslaughter, but that's just based off of the video here. 1) Dead guy repeatedly threatens the lives of the shooter(s). Given the words are backed up with threatening behavior by an armed opponent, I think this could hold weight in court. 2) Shooter calmly, levelly responds and doesn't appear to be aggressive, and doesn't seem to be wreckless in his behaviour at all. Given that, I think he could possibly argue he was acting in defense. (FYI, by most laws as I understand it, you don't have to have suffered bodily harm, but have substantiated reason to fear bodily harm). 3) Given the dead man's murderous threats and arming himself, I think it could possibly be argued that the amount of force that was used is justified. 4) In laws I'm familiar with, Stand Your Ground includes not having to retreat, even if that's an option. So the fact he could leave probably won't make a difference. 5) Stand Your Ground applies to anywhere you have legal right to be - often confused with Castle Doctrine (which is the right to defend yourself on/in your property. I believe this is a public dumpster? That would give him legal right to be there. The one thing that I see that seems like it's going to kill them in court, is Jr. with the shotgun. It's possible they retreated, and came back with the firearms (presumably Jr. wasn't packing a shotgun in his waist band), which a prosecutor could use to argue against standing ground. "You left, and came back armed, and re-aggravated the situation. Stand Your Ground doesn't apply." |

I agree. Unfortunately, though, we don’t see what happened in the 2 seconds before the weapons were fired. The deceased had threatened the two men with death. Yes, it may have been just hyperbole. But he also may have been deadly serious and tried to grab the gun. If that’s the case then it would be a “him or me” situation. Still, such a stupid predicament to get yourself in.

First of all, the title of the thread is funny as fuck Secondly, the older dude with a gun, he is got some big tits for sure Thirdly, they are a bunch of hillbillies, the victim was also a little bit over the top with the death threats. Things escalated NOT so quickly... still dying over a fucking mattress... This is darwin at work. How come they were released on bail in the first place?
