I think the aggressive trespasser had enough time to consider after he saw that the land owner got his gun and told him to leave
in texas he has the right to protect his property with force, I am not an expert but I would count the warning shot as force...the trespasser grabbed the gun and threatening the life of the land owner which would permit him to use deadly force

as far as I know there haven't any charges been pressed

The use of deadly force is not justified under this subchapter except as provided in Sections 9.32, 9.33, and 9.34.

(e)A person who has a right to be present at the location where the force is used, who has not provoked the person against whom the force is used, and who is not engaged in criminal activity at the time the force is used is not required to retreat before using force as described by this section.

(f) For purposes of Subsection (a), in determining whether an actor described by Subsection (e) reasonably believed that the use of force was necessary, a finder of fact may not consider whether the actor failed to retreat.

If he was there to pickup his son, and/or to find his whereabouts, I think he had a right to be there (especially if he has court ordered joint custody). And it wasn't like he was trying to bust into the dudes house either when he got shot.

As would I. I don't know if this is the case here, but in many places even firing a warning shot is a crime though. But we'll find out eventually, the state will press charges even if the family doesn't want to.

does joint custody give you the right to violate another man's property? he has the right to have time with his kid but that doesn't mean he is allowed to get the kid from another property where he is told to leave... he can sue the wife for violating custody terms, I don't think he gets the right for trespassing... as it appears the kid wasn't even there, he could call the wife to get the whereabouts...

but yes, I fully agree, that we will see what comes out of this... in the end we are just interpreting laws but a judge/jury will make the final decision, regardless of our opinions or postcounts

I went to pick up my son, but the lunatic that owns the property pulled out a machine gun, so I immediately left the property and called the police. The man was arrested and charged for death threats while brandishing an illegal firearm, and I was awarded full custody of my child. I spent the rest of my life drinking Mill St Organic lager, watching DR videos and investing in Canadian real estate.

Americans: I am going to John Wayne's house to pick up my son.
I am both a model T-800 series Terminator and Neo from the Matrix. I think it's wise to further escalate a situation involving a complete lunatic with a machinegun. I will establish that I am in fact the Alpha male. As will my opponent. I watch UFC and steven seagal movies and am quite confident that I can dodge bullets while also removing the weapon from this guy so I'm gonna talk smack first, ask questions later. I died.
