You're probably right but the sentence will likely be manslaughter since he fired a warning shot and did not intend to shoot unless threatened. The shooter may have some weight for defense in that the angry dad said he was going to take the gun and use it on the shooter if he did not shoot him.

He should have walked back to his car and waited for law enforcement

Dude shouldn't have brought a gun out, instead also just call law enforcement.

Ex husband should have walked away when he did, simply for his wife's sake in the vehicle and his step kid in the back seat, to keep them from danger like most men would.

Guy who shot, was legal to do so due to Texas laws.
