Common misconception. It's phone calls that fall under Federal Wire Tap laws. All parties on the phone must be aware of recording without a Wire Tap Warrant. This is why you hear the, "phone calls may be recorded for quality control and customer protection" messages when you call places who record. With surveillance cameras, you will see signs posted that say, "video and audio recording on premises" which is a State law issue. Here in Nevada, it's a, "single party state" meaning, as long as one of the parties being recorded is aware, it's legal. As far as hand held recording goes, the Federal Courts have said, "there is no expectation of privacy in public" so anything goes as long as the behavior isn't lewdness. |

Thank you. Finally someone talking sense about the situation. However, if this dude that he shot had been bullying him & he had enough of it I could see where he could claim that he had enough of it but I just do not know the full circumstances.

Personally i think the world would be a better place if every american was armed and used their guns for all sorts of disputes. Murder should be legal. Defund the police.

Under the federal Wiretap Act, it is illegal for any person to secretly record an oral, telephonic, or electronic communication that other parties to the communication reasonably expect to be private. (18 U.S.C. § 2511.)

I forgot to add that, yes I know it varies state to state, but I would think this is a state where it's illegal, otherwise we would have audio. It's illegal to record audio in general, unless you're a cop. We couldn't even have audio with surveillance on post in the army. |
