He is shot by the rifle he is holding and not by the guard, but it appears the bullets fire out the back of the gun and not from out of the barrel. Malfunction of some sort killed him. No murder here.

It also looks like a bullet casing rolls across the floor. If the guard had shot him the casing would have been on the other side of the desk.
