Yes its true the victim had his hands in his pockets (holding up his pants) and continued to back away. Someone pointing a gun at you might make you take a few steps back. I would think this is exactly the type of senario that they train for, and if it was a training exercise he would have failed.

There is something seriously wrong with the mindset of law enforcement today in America.
