1. The cyclist knowing that there are buses passes by him, he still don't want to stop. 2. The guy getting in the car knowing that there's a bicycle coming, he still take his own sweet time to open the door, get in, sit properly before closing the door as if he's getting in the car from his home parking lot. |

Blame is on the arrogant prick who opened his vehicle door into a travel lane, rather than wait until traffic was cleared before occupying or obstructing that lane. The laws of the road apply to everybody who occupies the road, including peds and people opening their car doors.

Blame is also on the bus that ran the rider over. The bus had a duty to yield the lane to other vehicles ahead of him. While passing a slow moving vehicle in a travel lane, the passer is responsible for yielding to that vehicle. The bus driver should have recognized the dangerous situation with the car door hanging open and slowed the fuck down for like two seconds.  |

Any judge enforcing traffic laws and code will crush your infantile ignorant defense by applying the laws: The biker was moving (straight) so he had priority. The bus has by law the obligation to be able to stop in time. The (driver of the) SUV has by law the obligation not to hamper traffic by any manouvre while entering or leaving as it is a parked vehicle. |
