No, it would be mutilation of a corpse if they had stumbled upon the corpse and started stabbing it. The injuries sustained by this corpse happened while in the course of committing murder, so it would be overkill. Everyone knows this |

Lol, “Everyone knows this” right. In the event you lived in the US, killed another person and then afterwards mutilated their corpse somewhat like this person did you would not be charged with Overkill you would be charged with mutilation of a corpse in addition to murder charges in whatever degree chosen by the prosecutor. Everyone knows this. At least any intelligent person who understands anything about the law. |

No, you dolt, they would be charged with plain murder, with overkill being used as an aggravating factor. Mutilation of a corpse only becomes relevant if the person hasn't already committed murder, and even if some zealous prosecutor includes it along with the other charges, it is usually tossed out during plea negotiations. Only a fucking idiot would be convicted of both murder AND desecrating a corpse. Now be quiet before I desecrate YOU. |
