No, you dolt, they would be charged with plain murder, with overkill being used as an aggravating factor. Mutilation of a corpse only becomes relevant if the person hasn't already committed murder, and even if some zealous prosecutor includes it along with the other charges, it is usually tossed out during plea negotiations. Only a fucking idiot would be convicted of both murder AND desecrating a corpse.
