Pretty sure it's the same in all countries.
You're supposed to make sure you are clear first before overtaking. And most of the time, you shouldn't overtake, multiple vehicles at a time (like the Eastern Europeans love doing) as you increase the chance for oncoming vehicle to appear.

Obviously the BMW fault. But the biker fucked up too. He had time and opportunity to maneuver into the middle. The car that filmed the accident should have slowed down and gave the BMW more room and he might have moved over before the bike came. And it would have given the biker more room to make a last-ditch turn. And the car in front of the filming car should have moved over to the right as far as possible.

These cars acting like they can't touch grass. The BMW should have moved over left all the way off the road.

One thing I noticed when replaying the vid is the motorcyclist, seeing the car in his lane, starts a move toward his right and into the cars' path-of-travel. This is a common error, as the motorcyclist target-fixates on the one thing they're trying to avoid, which in most cases is the wrong thing to do. The car was braking and moving to the shoulder of the road as a collision avoidance maneuver, and the motorcyclist, sensing imminent doom, ensured a collision by moving further right. Most of the time a motorcyclist does not execute a skill properly, or worse, does nothing to avoid a crash. In this incidence, he actually may have done more harm than good by improperly executing his avoidance maneuver.
Does this obsolve the car driver of liability? Absolutely not. The BMW violated the motorcyclist's path-of-travel and failed to yield right-of-way to the motorcyclist. I'm just saying the motorcyclist had more of a say in the outcome of this tragic incident than first noted.

Because the motorbike rider is russian perhaps? One thing thing I know for sure is that it is a country foreign to mine and I don't want to pretend that I know the rules of said country, no matter how mundane it may seem! (This was NOT in my country due to traffic lanes. Stop being so belligerent!)
