57-year-old Motorcyclist Hits Truck and Dies
Brazil, 57-year-old motorcyclist, V.D.S died in an accident involving a truck on Saturday afternoon. The collision took place around 4:30 pm. The victim was on the main road when he hit the side of the truck. He suffered a severe traumatic brain injury, going into cardiac arrest. |

Nobody to blame but the truck driver on this one. Didn’t even attempt to make sure traffic was clear before cutting across.

Who has the stop sign? This is such a ridiculous intersection if there are no stop signs. I can't make out any. And visibility looks pretty shit, the buildings block being able to easily see other/intersecting traffic on the road. But in this intersection, they should have a 4 way stop. That would force all drivers to stop before proceeding, and would obviously give each driver a better chance to get thru safely. I think accountability would be more on the town/city road safety department for not having created a safer intersection. |

In the United States, the person who is turning into traffic is required to yield to oncoming traffic. This would make it the truck drivers fault. You would know this if you completed drivers education. |

Good question. Here’s the answer: The truck driver has a stop sign that is visible to him but difficult to see from the camera perspective. It is attached to the wooden post just before the crosswalk. There are two visible white straps that are holding it in place and the red of the sign is just barely visible from our angle. There are many markings on the main road that would also indicate that it has right of way, with or without the stop sign. For one, the solid line separating oncoming lanes continues through the intersection, while the side street the truck comes from has no visible lines or lane in the intersection. The main street has a bike lane that is also not broken up by the intersection. These are clear indications of ROW. Entering that street from an intersecting road without a stop sign would have the same requirements of entering it from a parking lot, garage, or driveway. You don’t need a stop sign to know this. You just have to look at the road itself. This is a pretty well taken care of road too, with clear markings and solid infrastructure. There would be no claim against the city to say that it was unclear who had ROW based on this footage. These types of intersections are common throughout metropolitan areas and even small towns. The main road I take each week has intersecting streets all along it. Neighborhoods typically have the stop signs, while the commercial zoned areas do not. They are privately owned roadways leading to stores and businesses. If there was a stop sign at each of these intersections it would be a confusing maze of stop signs all down the road as you pass strip mall after strip mall. You are expected, therefore, to know that a main road is a main road and that when you are entering it, turning onto it, or crossing it, that it is your responsibility to yield to cross traffic. In layman’s terms, look at in which direction the lines in the center of the intersection are going. If they are perpendicular to you, stop. If they are parallel, you have ROW. If they intersect or disappear then it is likely a 4 way stop. |
