Re: Horrific Extrajudicial Killing
Looks like he at least was able to get some sort of justice after his death, if anyone was interested in the outcome. Maputo - The Maputo provincial court, sitting in the city of Matola, on Thursday sentenced the former head of search operations in the Criminal Investigation Police (PIC), Alexandre Balate, to 22 years imprisonment for first degree murder. The court found Balate guilty of the murder of a suspected criminal, Abranches Penicela, on 14 August 2007. It found that Balate had led a group of eight policemen who kidnapped Penicela in the locality of Belo horizonte, and drove him to Xinavane in Manhica district, about 90 kilometres north of Maputo. There Balate shot Penicela in the neck and set him on fire. But the fatally wounded Penicela did not die on the spot. He was rescued and taken to Xinavane rural hospital. Although he had suffered fourth degree burns, over 72 per cent of his body, he was still able to speak. In his dying words he told medical staff what had happened, and named Balate as the killer. Penicela stressed that Balate had injured himself during the attempted execution, and had burnt his arm. This detail was crucial for the prosecution, since it turned out that Balate did indeed have a burn on his arm. According to a report in Friday's issue of the Maputo daily "Noticias", the judge Pascoal Jussa recognised Balate's role as a man who hunted down criminals - but pointed out that in this instance he had not acted in the service of the state, but on his own. He had kidnapped and killed Penicela out of motives of personal revenge, and not to carry out his police duty, said Jussa. He had committed premeditated murder - instead of arresting Penicela and taking him to a police station, he had chosen to drive him into the bush and set him on fire, causing injuries that led to his death. "It was proved that the accused had the unequivocal intention of causing the victim's death, and it was against his will that this did not happen immediately", said the judge. "He achieved this purpose later, because the victim could not resist the severity of his wounds" In addition to the 22 year jail term, Jussa ordered that Balate pay compensation of 500,000 meticais (about 18,800 US dollars) to Penicela's family. He also ordered the Public Prosecutor's Office to initiate criminal proceedings against the other seven policemen who participated in the murder. One of them, however, the policeman who drove the car, is already dead. He was shot on the Maputo coast road, in what looked like a revenge killing. |
