A woman who was shot in the eye after leading police on a chase while she was drunk is suing northern Utah authorities for excessive force.

Kristine Briggs Johnson announced the lawsuit Thursday with her attorney, Robert Sykes.

She acknowledged that she made a mistake in driving impaired and failing to pull over for police. But, she says the Morgan County Sheriff's deputy didn't need to shoot her. She is blind in her left eye.

Peter Stirba, attorney for Morgan County, says the officer's actions were justified. He said Johnson's blood-alcohol level was nearly four times the legal driving limit, putting people at risk while she drove.

Davis County Attorney Troy Rawlings ruled the shooting unjustified, but prosecutors did not file charges against the officer.

This is a good shoot and a civil suit won't go anywhere. This type of scenario happens all the time and is always a good shoot. The drunk woman was using her vehicle as a deadly weapon and was hitting the police cars in her lame assed attempt to escape. The officer's use of deadly force was countering the drunk woman's use of her vehicle as a deadly weapon against the officers. If the officer had not fired on the drunk woman, she would have continued using her vehicle as a battering ram potentially injuring or killing the other officers on scene. She got drunk, she got in a vehicle, she drove the vehicle, she refused to stop for officers, she lead them on a chase, she refused to follow orders to stop, she used her vehicle as a deadly weapon against officers, and she wouldn't stop her felonious activity until shot. Whoever that county attorney was that decided the officer was unjustified was an idiot. This exact thing happens all the time and in virtually all cases the officer was justified and usually gets a commendation or medal for saving his fellow officers.
