Re: Woman Charged with Battery & Resisting Arrest During a Traffic Stop
It's common sense not to touch a cop but you can tell the officer is just being spiteful and unreasonable by arresting her for that. Just the kind of officer who waits for the tiniest possible infringement (or percieved infringement) and arrests a completely law abiding woman for something cross his wife probably said to him this morning But anyways nothing will come of this, the police are untouchable |

Re: Woman Charged with Battery & Resisting Arrest During a Traffic Stop
Ok, I watched the video four times. I have questions, but I'm not sure they're relevant to the incident, but here they are, 1.) What was the initial reason for the traffic stop and contact? 2.) Why was the police crusier parked in front of the suspect's vehicle? 3.) Why were there three Deputies on scene from the beginning? 4.) Where are the other video recordings...three Deputies three recordings? 5.) Where all the Deputies designated traffic Deputies or just the arresting Deputy? 6.) Was this some type of static traffic enforcement operation? I'm not sure we'll ever know the answers to my questions above, or if my questions are actually relevant to the incident. In any case, the arrest was absolutely legal by California law and by standard arrest/use of force policy. There's nothing illegal in the Deputies' actions. Now that being said, there are some minor points. The suspect was mouthy and aggressive (notice how she started using her hands in front of her almost immediately when the Deputy walked up to the car) and almost immediately grabbed at the Deputy...which is a really big common sense no no under any circumstances. The Deputy's reaction was normal given the circumstances. The suspect continually resisted the Deputy's instructions to get her out of the car and she repeatedly refused to comply. She continued to verbally refused to comply with the Deputy and was forcefully removed from her car and plasced in handcuffs. She continued to verbally and physically refuse instructions even repeatedly telling Deputies that she was not going to jail. It was a petty arrest, but the suspect asked for it and committed the crime of Assault on a Peace Officer not the more serious Battery on a Peace Officer. I'm sure this will be plead down to a disturbing the peace or minor resisting a lawful arrest. The suspect acted like an asshole and the Deputy acted within his authority. I personally think he reacted a little too fast and should have not gotten so close to that open window. The whole contacting from the suspect's front is a little stupid...the Deputy's a lefty and his firearm was right in that window. He used poor tactics and had a quick fuse, but it doesn't matter, the suspect was stupid for putting herself in that position in the first place, it's just a traffic ticket. |

Re: Woman Charged with Battery & Resisting Arrest During a Traffic Stop
Ok...on my fifth viewing I think I saw what happened. The suspect actually ripped off the left side of the Deputy's yellow traffic vest to see his badge and name tag. She actually admits to this on the video right before and after she's ejected from her car...it's hard to hear and see, but it's on there. She admits she ripped the vest to get to the Deputy's name tag. What a dumbass. By the way, what kind of name is Bana Mouwakeh? And what in God's name is she wearing...that alone should be case for arrest. Yuk. In this case, she should be charged with Assault on a Peace Officer...she blew it.
