July 16 2009 THREE men have appeared in court in relation to an alleged assault at a Prahran Hungry Jack's outlet on Monday.

Konstantinos Kontoklotsis, 32, of Brunswick appeared in Melbourne Magistrates' Court this afternoon charged with affray, recklessly causing serious injury, intentionally causing injury, and unlawful assault.

Sporting a bandage to his right hand, Mr Kontoklotsis was going to apply for bail but withdrew the application.

His lawyer Tim Gattuso applied for a suppression order on Mr Kontoklotsis's name, but Magistrate Jelena Popovic refused the order.

Mr Kontoklotsis was remanded in custody for a committal mention on until October 8.

Nathan Karazisis, 24, of Burwood East and Mark Bogtstra, 21, of Camberwell appeared in Melbourne Magistrates’ Court charged with affray, recklessly causing serious injury and recklessly causing injury.

The pair did not apply for bail.

Their lawyer Peter Ward said the pair surrendered themselves to Prahran police station this morning.

They have been remanded in custody to reappear in court on October 8.

Victim Luke Adams, 19, has been discharged from the Alfred Hospital, where he was being treated for serious head wounds sustained in the alleged attack.

Luke's father Peter Adams told 3AW radio his son's condition was stable.

"He still has some horrendous injuries but with time and proper care we are confident, we are hopeful he will recover in the long term," he said.

Luke, a promising young footballer from Frankston South, was to line up for the Victorian under-19 team this Sunday.

The gentle champion with an unblemished sports career was knocked unconscious after being put in a headlock. He has multiple head fractures.

He was in the care of specialist ophthalmologists, neurosurgeons and facial reconstruction experts while being treated at the Alfred.

Security footage of the attack shows Luke being pulled into a headlock, during which he loses consciousness before then being released to fall face-down with sickening force on a stone floor.

One of his mates is seen desperately trying to hold Luke's gaping head wound together to staunch the blood loss while the attackers continue to punch and kick around him.

Luke's traumatised parents and Prahran police have slammed the attack and warned the people involoved they should turn themselves in.

The fracas flared at a Prahran Hungry Jack.s - on the corner of Malvern Rd and Chapel St - before dawn on Monday.

EXCLUSIVE: HUNGRY Jack's bashing victim Luke Adams is rebuilding his life after the callous city beating that left him fighting for his existence.
Just seven months ago he lay lifeless in a coma after the brutal attack that appalled the nation and highlighted the seriousness of Melbourne's seedy night life.


But he has now bounced back with a fresh new outlook, and is slowly piecing his life back together.
Speaking publicly for the first time since the horrific incident, the budding football star revealed he was planning a footy comeback, had returned to work and was hoping to begin tertiary studies.


But he can still not bring himself to discuss the attack that left him for dead.

"I'm over it. It's not something I want to talk about or bring up again, I'm just over it," he said.
Mr Adams, 19, said he was simply acting peacemaker after a fight broke out between his friend James Mitchell and a stranger at Hungry Jacks in Chapel St, Prahran.

Shocking security footage released in the aftermath of the one-sided brawl in the early hours of July 13 showed Luke and his mates assaulted in an unprovoked attack that unleashed angry demands for action to end drunken street violence.

Today he is making solid progress in his physical recovery despite a host of injuries that serve as a constant reminder of the incident.

He has failed to regain his sense of smell, has a hole in the bone above his left eye and will suffer undetermined long-term effects due to the severe impact to his brain.

Socially he continues to choose carefully where he goes and who he is with.

Most striking is the deep welt from his hairline to his left eyebrow, the legacy of his head wound when he crashed, face-down and unconscious, after being throttled. But he insists things are good, following a recent trip to South America.

"I just went away for a bit of a trip to get away," he said.

"I'm doing OK. I'm hoping to play footy again, but I'm not quite sure at the moment," he said.

In the meantime Mr Adams is planning a return to study.Dad Peter said while Luke was recovering well, there was still along way to go.



"This event has and continues to have a major traumatic effect on Luke's family and friends," he said.

"The most difficult aspect to cope with is the uncertainty.

"Do we know the full extent of his injuries? What psychological damage may have been done that is not yet apparent? What would be the effect of another blow to his head?"

Mr Adams said he was preparing himself for the sentencing of Nathan Karazisis, 24; Mark Bogtstra, 21, and Konstantinos Kontoklotsis, 32, next month.

Bogstra and Konstantinos pleaded guilty to charges of affray and intentionally causing injury to James Mitchell and Karazisis an additional charge of recklessly causing serious injury to Luke Adams.
"I am anxious that there will be a suitable and just outcome at the sentencing hearing in March, a sentence that is appropriate for the callousness and severity of the assault," he said.
