HOUSTON A former Harris County state district judge accused of scratching his next-door neighbor’s car with a key was indicted Thursday June 18 2009 on a state jail charge of criminal mischief.

If convicted, Woody Ray Densen (Rep), 69, could be sentenced to a maximum of two years in state jail.

Grand jurors watched security-camera images taken in May by the judge’s neighbor that show Densen walking his dog past Adam Kliebert’s Range Rover.

Densen can be seen moving his left hand close to the vehicle as he walked by.

Another video shows Densen walking by the car at a different time, moving his right hand closer to the vehicle as he passed it.

Densen’s attorney, Robert Pelton, said that the judge passed a lie detector test and that none of the video footage directly shows his client marking the car.

"It doesn’t prove he committed a criminal act and that’s why we are so disappointed with all of this," Pelton said.

"He got indicted for walking behind a car someone had scratched up."

Densen was a judge in Harris County from 1983 until he was defeated in 1994.

He then served as a visiting judge until 2007, when the Harris County Criminal Lawyers Association filed a complaint against him with the State Commission on Judicial Conduct.

Pelton said the complaint was dismissed and Densen is eligible to work as a visiting judge although he turns down offers.

In 1999, the commission publicly admonished Densen for distributing invitations for a campaign fundraiser from the bench and a court coordinator’s office.

Kliebert, a home builder, did not immediately return a call seeking comment.

But in interviews with Houston TV stations, Kliebert said he set up the camera because he suspected that Densen was scratching his car.

The damage totaled about $3,000, Kliebert said

Pelton said that Kliebert has previously complained about Densen’s dog barking and that Densen has had problems with Kliebert blocking the sidewalk with his car.

“This sort of fell in the middle. This is not an order that he has to resign. It’s not an order putting any kind of punishment on him, other than what it says, a public warning,” said 11 News Legal Expert Gerald Treece. “It’s not lying. It’s really not perjury. It’s that I’m saying that I did this offense, but then when he gets to the State Judicial Conduct Commission, even though I said I admitted to this offense, here’s the extenuating circumstances.”

Densen served as a criminal district court judge for 12 years. He then retired and served as visiting Judge. He is still eligible to sit as a visiting Judge.

Kliebert and Densen still live next door to each other.

I was arrested for a felony charge in 1987 in Johnson County Kansas for walking around the car and pointing at the interior. Hung jury then I pleaded misdemeaner. That sucked, I think it was my friend I was with that did it!

The people who drive range rovers are pretentious pedantic peckers. :

As for the pointing into a car it's a load of crap. The states have come up with these stupid "car prowling" laws to bust you for walking down the street enjoying the sights.

Thanks for the excellent video. I have the exact same problem with a person living on this street. He trespasses, drives drunk, vandalizes, assaults but when I put up a sign that reads "we support M.A.D.D." He complained it was "disrespectful." What? My videos show him clearly doing wrong things. Thanks for the video, I'll get my footage to the proper authorities for prosecution.
