Shana Shaw Arrest (2 Videos)

I’m including 2 articles, 2 videos, plus a Facebook post from Shaw. The first video was shot by an eyewitness but only shows police pulling her out of the car and to the ground. The second video is the body cam footage from the arresting officer showing the entire encounter start to finish. Did the officer use excessive force, or was the officer’s handling of Miss Shaw justified?

Article 1

A 26-year-old Saugerties woman who was arrested following a traffic stop for failure to signal a turn, part of which was caught on video, said an Ulster County Sheriff’s deputy used excessive force that gave her a concussion, nerve damage in her wrist from the handcuffs, and bruises on her body, putting her out of work for three days.*

Shana Shaw was charged with resisting arrest, driving with a suspended license and marijuana possession. She was released with an appearance ticket.

Shaw said she filed a formal complaint and plans to sue the department.*

The arrest occurred Monday, December 28 at around 3:45 p.m. in the parking lot of Buffalo Wild Wings on Ulster Avenue in the town of Ulster. The 43-second video, which was posted on Facebook and first reported on by Kingston Wire, was recorded by a bystander who did not give his name. In it, Shaw can be heard saying “you can not legally arrest me, I’m in a parking lot.” The video shows a deputy pulling Shaw out of the driver’s seat and onto the ground and behind another parked car, out of view of the camera person. The camera person then moves to a position where he can see between the cars, and the video shows Shaw with two deputies kneeling over restraining her; they tell her to stop resisting, and she screams “I’m not resisting” twice. At that point, the video ends.*

A release from the Ulster County Sheriff’s Office detailing the arrest reads, “Ms. Shaw fought with deputies when they attempted to take her into custody.”*

“A representative from Mrs. Shaw has reached out for a meeting to discuss this incident,” said Sheriff Juan Figueroa in an email on Tuesday, December 29. “There is an ongoing preliminary investigation as this occurred yesterday, no further information is available at this time. A full investigation will be completed,* If there is any wrongdoing on behalf of the members of this office, they will be held accountable.”

The day after the incident, Shaw told Hudson Valley One that she filed a complaint against the deputy who pulled her out of her car, whom she identified as Officer Woltman. A spokesperson for the sheriff’s department confirmed that the deputy in the video is Deputy Brian J. Woltman.*

Shaw said she also plans to sue the police department.

“I’ve been targeted by the police for a while, so this isn’t nothing new to me,” said Shaw.*

She recalled what happened before and during the arrest.

“I’m a nursing assistant – I’ve worked all day and I was picking up food, something I do regularly,” said Shaw. “I pulled into the parking spot and out of nowhere an unmarked SUV was behind me.”

She said she was already parked and was “confused” to see deputies pull up behind her.*

“Then he asked if my name was Shana,” said Shaw, which she didn’t say yes or no to. “He knew who I was already. He proceeded to say step out of the car. In my head I don’t have enough information and he knows who I am so I felt uncomfortable…I am an African-American and cops are shooting us in the head and killing us.”

She then pulled out her own phone to start recording the situation because she “didn’t know what was going to happen” next, considering she’s seen “many people get beat up by cops.”

“I am terrified by them,” said Shaw. “I don’t even want to leave my house after this.”

Shaw said the deputy “immediately became aggressive” after she pulled out her phone to record him.

“This all occurred because of [my suspended license] I guess,” said Shaw, who also refuted the claim that the officers found marijuana in her car.*

She said she asked for legal representation as soon as she was handcuffed.*

“I feel fully taken advantage of,” said Shaw. “I don’t think there needed to be two male officers to yoke up a girl that is 130 pounds, in her scrubs from work, and I’m an essential worker.”

“Even if I broke a law, that was still excessive force,” said Shaw.*

She’s calling for any previous complaints about the deputy to be revealed and for the topic of police brutality to be addressed.*

“I want to feel comfortable where I live,” said Shaw. “I shouldn’t have to worry about whether or not I’ll come home.”

The Ulster County Sheriff released the body cam footage yesterday from the arrest of a 26-year-old Saugerties woman that led to claims of excessive force following a traffic stop in the town of Ulster.*

Shana Shaw of Saugerties was arrested December 28 around 3:45 p.m. on the charges of resisting arrest, driving with a suspended license and marijuana possession. Shaw posted a 43-second video recorded by a bystander the same day, which showed her being pulled from her car and handcuffed on the ground by two officers. She told Hudson Valley One that she believes the deputy used excessive force, resulting in a concussion, nerve damage in her wrist from the handcuffs, and bruises on her body, which put her out of work for three days. She said she made a formal complaint and planned to sue the sheriff’s department.*
The 8-minute 39-second body cam video sheds more light on the interaction between Shaw and Deputy Brian Woltman that unfolded that afternoon in the Buffalo Wild Wings parking lot. The video begins with Woltman approaching Shaw’s vehicle. She asks why she was pulled over. The deputy responds: “you cut me off without signaling back there on 9W,” and “your license is suspended.” Shaw responds that she did signal and says she just cleared the suspended license but the paperwork was at home.*

Woltman replies, “that stinks.”

Shaw then suggests having someone pick up the car and explains that she’s there to meet a friend. Woltman then asks her to “hop out.” Shaw complies, and then asks why she had to get out of the vehicle. Woltman replies that it’s because she’s being placed under arrest for driving without a license.*

At this point, the tone of the interaction changes.

“Let’s not make things difficult,” says Woltman.“Let’s make this very easy.”
Shaw says the deputy can follow her home to see the paperwork for her license and that she can prove it.*

“No, I’m not following you home,” says Woltman.*

“So you’re going to arrest me after I just left work, and I’m a nurse?” says Shaw, who said earlier this week she is a nurse assistant.*

Woltman asks Shaw to step closer to him. She says no and gets back into her car, saying she was going to call her lawyer.**

Deputy Woltman follows her, standing in front of the driver’s side door and calling for backup. He then grabs her arm and tells her she’s under arrest.*

For around the next six minutes, Deputy Woltman and Shaw go back and forth, saying “you’re under arrest, stop resisting,” and “I’m not resisting.” At one point, Woltman says “I’m going to taze you if you don’t get out of the car.”

When Shaw says someone is filming the interaction, Woltman replies he is also recording the situation. Eventually, another officer approaches from the passenger side, trying to calm Shaw down. He can be heard saying, “look at me, just listen to me for a second.”

Following that, the body cam video reaches the point at which the bystander video began: Deputy Woltman pulls Shaw out of the vehicle, and she can be seen handcuffed while laying stomach-down on the pavement. She yells “I’m not resisting” and “Ow, you’re hurting me.”

Shaw was then brought to the back of the police vehicle. She yells,“I fell on my fucking head,” before an officer shut the door with her in the back seat. The video ends shortly after that.

The Ulster County Sheriff’s Office’s Facebook post with the body cam footage has been viewed almost 300,000 times and led to over 4,000 comments.

In a post accompanying the video, Sheriff Juan Figueroa explains why it was released.*

“I found it prudent to release the body camera footage of the event that occurred on December 28, 2020 in a parking lot in the Town of Ulster, as this event has already garnered community attention. Encounters with law enforcement can be unpredictable, and although this is not to say one way or the other that anyone is at fault, this will at least shed light on the event as it occurred in real time. Like all technology, devices such as body cameras, cell phones and similar devices are machines with limitations.* This complaint remains under investigation.”

cop could have followed her home to see the paperwork but he already made up his own mind and went for the hard way, "that stinks". After he tells her she's under arrest she panics and she's resisting.
A statute rejecting the traditional rule might say something like this: “You can’t use force to resist if you know or should know that you’re being arrested by a police officer, regardless of whether the arrest is legal or not.”

lmao apparently this lady nor the people in the comments know how the law works. If your license comes back suspended, it is the officers job to arrest the alleged criminal, after all, it is a crime until proven in a court of law with evidence, which we'll get to ladies.

So the officer should follow you back home? So they can risk a car chase and put lives in danger, from an individual a commenter had already pointed out is not all emotionally up there in the noggin.

Take your word for it?

Not sorry snowflakes, that's not how the law works. You wear the cuffs and take your battle to court OR you go sit in bookings for 1 hour, use your free call to call mommy and ask her to bring your documents down to the precient, and wham bham kitty kat slam, you're free with no charges. BUT NOW you're just racking up charges for being a brat even IF your license does so happen to come back clean.

..Ummm... what's the big deal here? Please don't even start with she is a 'nurse' and or she is black, or parked up...

She was driving WITHOUT a licence. He followed her when she didn't abide by the rules of the road.

She pulled over and parked. He followed and arrested her.

All the screaming and 'you're bending my arm, random NOT resisting.' This is ridiculous.

It seems that people that are CLEARLY resisting, and screaming about it, feel that they're doing the right thing. Unbelievable.

I would have tazed as SOON as she started screaming.
