Road Rage Defense Shooting
Happened 11/19/23 with a vidcam that had wrong date stamp. Terrain looks like up north. Rear-tag-only state. Most tags appear black lettering on white plate with blue stripe on left side in-line with tag number. |

The Fort Wayne Police Department is investigating a shooting that happened near the intersection of Lake Avenue and Maplecrest Road. Officers initially responded to the scene at 12:05 p.m. Sunday after reports of a road rage incident, according to the Fort Wayne Police Department. There were also reports that somebody was shot. Police say a man was shot in the arm and another person who wasn’t involved in the incident was shot. Based off statements given to police, the incident stemmed over road rage between two vehicles. The driver of one, a man, reportedly got out of his vehicle, approached the other driver and battered him. The driver then shot the man in the arm. A person not involved was also struck. Both people shot suffer non-critical injuries, according to FWPD. The driver that fired the gun was arrested for criminal recklessness with a deadly weapon. The other driver has pending battery charges. The situation is still under investigation. Dashcam video by Laura Scatena — who was directly behind the cars involved — shows the incident playing out as police described. In the video, the driver of the red van appears to fire three shots. Reckless shooting with other cars passing by etc. but the moron in the girly pants started the whole ordeal by cutting off the other. |

The shooter's defense will be interesting. Indiana has the Worthley Law, a stand your ground law that allows citizens to defend themselves when they reasonably believe they must use deadly force to prevent serious bodily injury. A lawyer would argue that the guy was actively being physically attacked and threatened by two people prior to shooting, and defended himself to stop the attack from escalating, in accordance with the Worthley Law. A lawyer could argue that if the shooter refrained from defending himself in order to avoid possible injury to bystanders, the attackers could have continued the attack. Indeed the footage showed that the gunfire stopped the active assault. My guess is in the prosecution process, the criminal recklessness charges will be reduced to Misdemeanor due to defense of an active attack. |
