In the video the officer may have not realized that the assailant had in fact been shot. He dumps a few rounds and as fatty just stands there he asks "anybody got any less lethal"Watch the video again. He asked for non lethal probably thinking the man had not sustained a lethal wound |

Generally, here in North America, if you exhibit the willingness to use deadly force in any way the police are justified in using deadly/lethal force at any point/time/where. I.E. in hostage situations they will negotiate until you kill someone, at that point you have shown you will use deadly force and all negotiating is out the proverbial window so to speak.(they will still try to negotiate with you but that is shifted to the last possible resolution option and nuetralization takes priority) the infiltration team at thaat point is to nuetralize you at all costs as quickly as possible.
