Guy Takes His Car and Drives into a Restaurant Trying to Kill People Inside
Peru. The lawyer for one of the people who was hit by Miguel A. in his car, indicated that the attacker would have had time to go to his house and try to get a gun to return to the restaurant, where he had previously been involved in a fight. The Judiciary has scheduled a hearing for this Sunday at 2 p.m. to evaluate the nine-month preventive detention order against Miguel Á. R. A. (51), who crashed his vehicle into the a restaurant last Wednesday after getting into a fight with some diners. According to the venue's security cameras, the suspect allegedly drove his vehicle toward the table where the people he had the altercation with minutes earlier were sitting, leaving one person injured and three others with minor injuries. The lawyer says "He left the establishment to go to his house, which is a block away, and according to versions that we have yet to corroborate—because we're going to call some witnesses— he tries to take out one of the weapons he allegedly had inside his house, but his wife prevents him. So, what he does is take his vehicle and goes to the restaurant, [where] as you can see in the images, he enters, threatens them, tells them he's going to kill them, that they don't know who they've messed with. Then he gets into his vehicle, and what you can clearly see is him gathering momentum to attack them and crashing the truck into the restaurant," he said. He also emphasized that there is a 15-minute gap between the time he is removed from the premises and the time he returns to it, a time during which he would have gone home and returned to the restaurant, demonstrating that his actions were "premeditated and intended to attack" people. "I could understand that a mitigating factor would have been violent emotion, which is when it occurs at the moment you suffer the aggression and that the attitude itself is what leads you to take some reprisal at that moment, but violent emotion can no longer be understood as a mitigating factor, since the time between when the events occurred and then the attempt to take justice into his own hands already passes about 15 minutes, which, precisely in the state he was in, which was less than the state of alcohol that the law allows, he did it with all intention and with all malice," the lawyer stressed. Regarding the request for pretrial detention against him, the lawyer maintained that the victims fear retaliation from the defendant. "Yes, there is a fear of retaliation, because over the days we've learned more things that we still have to confirm, such as requests to the airlines to see if he has purchased a ticket abroad for days after the event. In addition, we also have to confirm if he actually has weapons inside his home because, we understand, he doesn't have a license to carry one," he indicated. The lawyer also questioned the defendant's statement that he was in shock after the impact of his vehicle, which is why he failed to assist the victims. "He stated in his police statement that he was in shock and unable to help the victims because he didn't know how to respond. But the videos clearly show him backing up the vehicle, taking it out of the restaurant, going back inside to incriminate and threaten them, and then leaving without any problems," he asserted. "Obviously, there was no intention to repair the damage, but what's more serious about this is the lack of help provided to those affected. Any person in a state of composure—as he was, since his alcohol level was less than the legal limit of 0.50—can demonstrate that he was conscious at the time of the acts," he stated. He is being charged by the Prosecutor's Office with the alleged crimes against life, limb, and health—qualified homicide (alevosía) in the attempted degree and failure to provide assistance, to the detriment of four people who were in the establishment at the time of the collision. |
