MUNDELEIN, Ill. A north suburban man (54) claims police officers forced his wife to undergo sobriety tests in frigid January weather and then stunned him with a Taser after he got out of his car to check on her.

Tribune reporter Steven and Jean Kotlinski filed a federal lawsuit against the village of Mundelein and two Mundelein police officers for the New Year's Day incident.

According to the suit, Jean Kotlinski had a blood-alcohol level of 0 percent, she was not charged.

Police also illegally arrested Jean Kotlinski, according to the suit filed in U.S. District Court against the village of Mundelein and Mundelein police officers Anthony Raciak and Richard Turek.

The seven-count suit, which seeks a jury trial, alleges officers used excessive and “unjustifiable violence,” which is captured on video.

It also claims violation of the Fourth Amendment for excessive force and illegal seizure, as well as false arrest, failure to intervene, malicious prosecution and battery.

The suit seeks punitive damages against the village and the officers, as well as attorneys’ fees and any additional relief.

The officers drew their Tasers and ordered him back into the vehicle, and he complied, telling the officers he has a heart condition, the lawsuit said.

But as he sat buckled in his seat, one of the officers opened the door, tried to pull him out, then fired his Taser into Kotlinski, the lawsuit said.

Both officers continued to shock him (total of 5 times) after he fell to the ground, according to the lawsuit.

Mundelein police were not commenting.

get back in the car means"GET BACK INTO THE CAR!" normal people or not we all have to behalf in their presence. [I]would have done the same thing as that cop.

Some of the cops I know won't even pull a car over for suspected DUI if they run the plates and it comes back registered to a female. They're just bad drivers.

That is scary but I agree with alpha.first.one that "get back in the car" means exactly that and if it were me I would've just shut the f up and been as nice as possible. The tasering is upsetting though.

I think the cops had a right to arrest him, he seems to have been able to resist two officers quite well for having a heart condition. The cops didn't know if the man was a fugitive whom may have been wielding an AK-47. Cops are taught to suspect everyone. I do believe that played out in front of a jury, you'll have a guilty of excessive force. Most jurors who watch this video will see them selves as the victim.
