Derick Wiley Shot Unarmed Lyndo Jones at His Own Truck, Acquitted in 2019

On November 8, 2017, Mesquite police responded to a vehicle-burglary call in a parking lot in the 1300 block of South Town East Boulevard. Lyndo Jones was at his own pickup truck, trying to silence a malfunctioning alarm, when Officer Derick Wiley shot him twice in the back. Jones was unarmed. He survived and was hospitalized, and he later described suffering lasting pain.

Prosecutors argued that Jones had his hands up when he was shot. Wiley testified that Jones was slow to obey commands and struggled as Wiley tried to handcuff him, and said he believed he might die. Jones was later charged with evading arrest, but the charge was dropped the same day. Wiley was fired from the Mesquite Police Department and indicted in December 2017 on a charge of aggravated assault with a deadly weapon by a public servant. His first trial ended in a mistrial in September 2018 after the jury split eight to four for acquittal. A second jury found Wiley not guilty on July 22, 2019.
