A Lee County judge has allowed the release of a video of the shooting of a Cape Coral police officer in April.
Yousel Lopez Rivera, 21, has been charged with attempted first-degree murder of an officer in the shooting of Officer David Wagoner.
Rivera's attorney, David Brener, filed a motion to block the video's release, arguing it would make it harder to seat a jury.
Lee County Circuit Judge Mark Steinbeck, however, ruled the video was not horrific and would not prevent Rivera from receiving a fair trial.
Wagoner was shot three times after pulling a vehicle over for an expired tag on Santa Barbara Boulevard, just north of Pine Island Road. One bullet ripped through his abdomen while two more were stopped by his bulletproof vest.
He underwent surgery the same day and has since recovered. He has returned to duty.
After the shooting, Rivera is accused of jumping on top of the driver, his girlfriend, and speeding away before crashing the vehicle into a house on Santa Barbara Boulevard.
He ran from the scene, police said, and was found hiding naked in a trash can after an extensive search.
