EL PASO, Texas El Paso Police Officer Matthew Jones is back on the job, after a grand jury cleared him of any wrongdoing in the June 13 shooting death of Gregory Smith.

The dashcam video shows Smith became unruly with Jones and pulled out something that appeared to be a gun, which in reality was a toy. Jones used a taser, but out of fear for his life fired a gun11 times at Smith, with more than half of those bullets landing in Smith's back.

"The non-compliance of the officer's directions resulted in this person dying," Police Chief Greg Allen said.

But not everyone agrees, including the founder of El Paso's Martin Luther King Committee, Johnnie Washington.

"I still don't see why the policeman was justified in shooting the man 11 times," Washington said.

Police admit Jones made some mistakes, including a poor patdown, not turning on the audio on his dashcam and not alerting other officers he had stopped Smith in the first place. But police said those mistakes are only minor.

"They don't invalidate in any way the justification for the shooting," Allen said.

This video is a classic case of suicide by cop. That guy knew what he was doing. Although I never want to see someone die or be hurt. The officer did what he had to do.
