Heather Lee Mogg was sentenced on January 25, 2023, to 5 to 15 years in prison after pleading guilty to manslaughter with intent but without malice in the fatal shooting of her boyfriend, Jonathon (Jonathan) Tippett, in Emmet County, Michigan.

At the time of the shooting, Mogg, then about 48 to 49, and Tippett, 50, were an unmarried couple who had been together for about seven years. They shared a home on State Road near Middle Village Road in Friendship Township, near Harbor Springs. People who knew them described the relationship as volatile and said they fought often.

The couple argued throughout the evening of August 10, 2022. Mogg shot Tippett once with a .45 revolver, causing his death. She said the gun belonged to her father and was not registered in her name. At around 8:48 to 8:58 p.m., she called 911 and reported that she had just shot her boyfriend. Emmet County Sheriff's deputies arrived to find Mogg still holding the firearm and Tippett deceased inside the home with a gunshot wound. She was arrested at the scene.

Mogg told police the shooting followed a physical altercation and was self-defense. She said she had warned Tippett she would kill him if he put his hands on her. Mogg claimed he had committed 15 to 20 acts of physical violence against her over the years, including pushing, choking, bruising and slapping, but no police reports documented alleged abuse against her. Tippett had pleaded guilty in 2007 to assault and battery against another woman.

Mogg had scuff marks and bruises, and a preliminary breath test showed a blood-alcohol content of approximately .29, above Michigan's legal driving limit of .08. She had a 2020 conviction for driving with a BAC of .32. Prosecutors noted her pattern of high blood-alcohol levels and escalating dangerous behavior.

Evidence included the .45 revolver, Tippett's fatal gunshot wound, Mogg's visible injuries and her high BAC. Available reports highlighted no extensive public details about digital evidence or major inconsistencies beyond her self-defense claim and the circumstances, including her intoxication, possession of the firearm and the lack of prior police reports of abuse against her. She was charged with second-degree homicide/murder, felony firearm and possession of a firearm while under the influence. Bond was set at $250,000.

Mogg waived preliminary examination and was bound over for trial on the original charges. On November 22, 2022, she accepted a plea deal and pleaded guilty to manslaughter with intent but without malice, reducing the more serious charges. 57th Circuit Court Judge Jennifer Deegan imposed the sentence. Mogg was housed at the Huron Valley Complex for Women, with parole eligibility set for December 22, 2027, and a maximum release date of December 22, 2037. Tippett's family expressed dissatisfaction with the outcome.
