Lubbock Man Convicted of Capital Murder

David Ricardo Carrillo was convicted of capital murder in the shooting deaths of Jennifer Cruz and Albert Martinez in Lubbock, Texas, and sentenced to life in prison without parole on February 8, 2018.

Carrillo, 29, and Cruz, 27, had two children together and had recently ended their relationship. Cruz was described as his ex-girlfriend and former common law wife. She was in a new relationship with Martinez, 30, known as Bo, who had four children. Carrillo said he believed Martinez had been sending him threatening messages on Facebook. Cruz's surviving children are not named in reporting and are not named here.

At about 2 a.m. on Saturday, April 18, 2015, Lubbock police responded to Cruz's report of a domestic disturbance at a home in the 5000 block of 44th Street. The 911 recording captured her pleading with a man she addressed as David to put the gun down, followed by gunshots. Cruz and Martinez were pronounced dead at the scene.

Officers arrested Carrillo at his home and recovered the handgun after he told them where he had hidden it. According to the arrest warrant, Carrillo said he had parked near the house, climbed through a bedroom window and brought a Glock handgun. He said he went there to confront Martinez about the Facebook threats, that Cruz and Martinez both came at him before he fired, and that neither was armed. Damage to the back door was consistent with his account of how he left.

During his police interview, Carrillo gave officers an account of the shooting that matched the summary in the arrest warrant. The date and length of the interview were not established, and the detectives who conducted it were not named. A Lubbock County grand jury indicted him on capital murder on June 25, 2015.

Carrillo was tried before Judge John J. McClendon III in the 137th District Court of Lubbock County. The Texas Seventh Court of Appeals affirmed his conviction in a memorandum opinion issued on November 13, 2019. The court's mandate issued on January 30, 2020, and the appellate record shows no later challenge.

The video is a police interview-room recording that runs about 121 minutes. It presents the interview itself without narration or a presenter.
