Hamilton Police Board Ordered to Pay Dixon Damages (JCS)

An Ontario judge ordered the Hamilton Police Services Board to pay Michael Dixon $46,000 in damages after he was arrested at gunpoint in August 2003 for a jewellery store robbery committed while he was on a bus.

The award included $10,000 in punitive damages. Superior Court Justice Kim Carpenter-Gunn described the officers' conduct as high-handed, arbitrary and highly reprehensible.

Dixon had just stepped off a GO Transit bus on his way home from work when officers arrested him. Witnesses had described the robber as a white man, while Dixon is Black. Police did not check with the bus driver, who could have confirmed where Dixon had been.

Dixon was questioned on camera at the station and spent more than three days in jail. He then lived under bail conditions for months before the charge was dropped.

Hamilton's police chief at the time, Brian Mullan, later apologized. Two officers pleaded guilty to misconduct under the Police Services Act, and the settlement terms required the force to make changes on racial diversity and equity.

It examines Dixon's recorded police interview, framing it around how an innocent person behaves under questioning, with commentary on the suspect's behavior and the detectives' technique over interview-room footage. It is not raw footage.
