Ethan Martin Broad Questioned in Avery Killing
Ethan Martin Broad, then 27, pleaded guilty to second-degree intentional murder after admitting he killed and dismembered Dystynee Avery, 19, at a Moorhead, Minnesota, apartment on April 3, 2020. Avery had been staying temporarily with Broad at the apartment. Prosecutors said the two argued while living together. Broad admitted in court that he hit Avery in the head with a pipe and cut her throat during an argument, then dismembered her body in his garage with woodworking saws and put the remains in the trash. Avery was reported missing in early April 2020 and had last been known to be staying with Broad. Her remains were recovered in late April 2020 at the Clay County landfill after a two-day search. Charging documents said Broad initially told police he had not seen Avery since April 4 and that she had taken her belongings and left. He then claimed another man had killed her, but surveillance video showed Broad alone dragging a blue tote from the apartment building to the garage. He later admitted the killing and dismemberment and claimed self-defense. The recorded interview took place on April 17, 2020, at Moorhead police, before Avery's remains were found. Broad was asked about a man he said frightened him, and he spoke about being afraid. He was arrested in April 2020. Three other people connected to the apartment were charged with aiding or helping after the killing. Broad was charged in Clay County with second-degree murder and pleaded guilty in January 2021 to second-degree intentional murder. A later request to withdraw the plea was denied. On May 21, 2021, he was sentenced to 367 months, about 30 years, the maximum for the plea, with credit for 400 days served. Andrea Payne and David Erno each pleaded guilty to aiding an offender and were each sentenced to five years of supervised probation and a $1,000 fine. Brandon Erbstoesser, the last of the four to be sentenced, was still awaiting sentencing at that time. The video is a police interview-room recording that runs about 141 minutes.
