Brett Kelly and Tracy Jones Police Interviews in the Killing of Gail Spencer
Four participants were convicted and sentenced to prison in a scheme that moved just under $1.3 million from a Macon, Georgia, law firm and ended with the suffocation death of office manager Gail Spencer, 58, in October 2012. Spencer managed the office of Calder Pinkston and Associates, a real estate law firm in Macon, Bibb County, and was authorized to make wire transfers from its accounts. She lived on Stinsonville Road and had a son, a sister and two young grandchildren. Tracy Michelle Jones, a secretary at the firm, devised a plan to hold Spencer at her home so Jones could make transfers in her place. Jones was in a relationship with Michael Brett Kelly. His half-sister was Courtney Nicole Kelly, and the fourth participant was Keith Anthony Dozier. Their ages were not given in the sources reviewed. On October 5, 2012, Jones, Dozier and Brett Kelly drove to Spencer's house. Jones asked to enter to use the bathroom, get something to drink and use the phone. Dozier and Kelly followed her inside and held Spencer while Courtney Kelly collected Jones and drove her to the law office. Jones transferred about $885,000 from the firm's escrow account into three accounts held by Courtney Kelly, in amounts of $205,250, $429,550 and $249,750. Two more transfers, for $245,000 and $163,000, followed on October 9, bringing the total to just under $1.3 million. At the house, Brett Kelly brandished a pistol, sodomized Spencer and suffocated her with a plastic bag while Dozier remained inside as a lookout. The medical examiner determined that Spencer died from asphyxia. Concerned neighbors found her body on her bed with a black trash bag over her head after she did not answer the door. The Georgia Supreme Court's account placed the discovery at about 4 p.m., while local reporting on the indictment gave October 6, 2012, as the date she was found. Jones, Brett Kelly, Courtney Kelly and Dozier were indicted in Bibb County in December 2012 on charges of murder, aggravated assault, burglary in the first degree, false imprisonment and theft by taking. On July 9, 2013, a grand jury returned a further indictment charging Dozier with malice murder, three counts of felony murder, aggravated assault, burglary in the first degree, false imprisonment and theft by taking. During Brett Kelly's recorded police interview with detectives in Macon, they named Spencer, gave her age as 58, described her family and pressed him to look at them and repeat her name. Kelly denied involvement, saying he "did not have anything to do with that lady." Dozier gave police a separate recorded statement in which he described watching the killing and said Kelly carried it out. His defense played that statement at trial. Jones testified for the prosecution and described how she got into Spencer's house. Michael Brett Kelly pleaded guilty before Judge Howard Simms on May 13, 2013, to murder, sodomy and further counts. He received life in prison without the possibility of parole, and his agreement required him to testify truthfully and cooperate in the investigation of every other co-defendant. Jones and Courtney Nicole Kelly also pleaded guilty. By November 18, 2013, Jones had been sentenced to life without parole and Courtney Nicole Kelly to life with parole eligibility. Tried alone from May 26 to May 28, 2015, Dozier was convicted on all counts and sentenced to life without parole for malice murder, a consecutive 20 years for aggravated assault and a concurrent 20 years for theft by taking. On June 3, 2019, the Supreme Court of Georgia affirmed his convictions for malice murder and aggravated assault, reversed the felony theft by taking conviction and returned the case for resentencing on misdemeanor theft. Jones, who filed no direct appeal, sought an out-of-time appeal in June 2019 on the ground that her plea lawyer abandoned her; the trial court denied it, and on March 13, 2020, the Georgia Supreme Court vacated that denial and sent the case back for a hearing. The result of that hearing was not found. Her sentence stands. The video is about 103 minutes of police interview-room footage showing Brett Kelly's interview. Tracy Michelle Jones, the secretary who devised the scheme, later pleaded guilty and was sentenced to life without parole. Jones voluntarily came to the police station for a second interview, conducted the day after her first. She denied knowing anything about the killing as detectives pressed her about her movements on the morning of October 5, 2012. The police interview-room recording runs about 120 minutes. The upload begins with about two minutes of the channel host recapping the case, followed by the unedited interview-room audio without narration.
