That's not how it works douche bags. An unborn child is not a human being. It is not a homicide if the fetus dies before it is born or is only part way out. He probably could have been charged with infanticide from the following sections of the criminal code. 238. (1) Every one who causes the death, in the act of birth, of any child that has not become a human being, in such a manner that, if the child were a human being, he would be guilty of murder, is guilty of an indictable offense and liable to imprisonment for life. (2) This section does not apply to a person who, by means that, in good faith, he considers necessary to preserve the life of the mother of a child, causes the death of that child |

Laci and Conner's Law or Unborn Victims of Violence Act of 2004 (Public Law 108-212) was passed into law on April 01, 2004 is a United States law which recognizes a "child in utero" as a legal victim, if he or she is injured or killed during the commission of any of over 60 listed federal crimes of violence. The law defines "child in utero" as "a member of the species Homo sapiens, at any stage of development, who is carried in the womb". the crime happened on 2007, Laci and Conner's Law was in place since 2004,, as to why the baby was excluded from the outcome verdict is simply beyond my understanding. |
