Okay, so I'm not really in the know on these things. Is that really a war crime? I'm asking because I don't think it's possible to enforce a rule that states you HAVE to take prisoners. So, if you don't, then killing a surrendering solder would not constitute war crime. Or am I wrong on this. Are the Azerbaijani soldiers from a country that is a Geneva member?

Yes, for those wondering I am completely oblivious to where the Azerbaijani soldiers are from. Knowing that information does not pay my bills or put food in my mouth, so there was no reason for me to go out of my way to know this shit. But, now I ask, because curiosity.

What constitutes a war crime is very much debated now that the world as a whole is not fighting uniformed soldiers.
The first step in evaluating a war crime is looking at the ROE or Rules Of Engagement.

Second you must consider if the “soldier” you are fighting against is a uniformed soldier or is he not. If he isn’t then there is no consideration given to the Genova Convention as it clearly states “uniformed recognized military personnel”

Third you must evaluate the theater of war for example in Syria neither side is uniformed both sides are fighting Guerrilla wars and neither side takes live prisoners and if they are by chance taken alive they aren’t that way for long. This is why the US and other countries are refusing to take a more public role though we are active in the region.

To simply state “this is a war crime” is hasty and a bit of an over reaction. By Western society’s standards this is probably a war crime or would at the least be investigated. The real answer is these two factions aren’t fighting by Western society’s standards therefore I’d have to say it is not a war crime. Cold blooded.... sure but as a professional soldier who is well versed in combat and regional issues abroad, I don’t see a war crime, only the standards of warfare in the region.

War crimes are defined in the statute that established the International Criminal Court, which includes:

Grave breaches of the Geneva Conventions, such as:

Willful killing, or causing great suffering or serious injury to body or health
