Update..

Officer talks attack, as murderer has death sentence overturned
REDDING, Calif. - On Monday the California Supreme Court overturned the death sentence for now 37-year-old Paul Gordon Smith, Junior.

Smith was convicted of torturing and killing 20-year-old Lora Sinner during a 1998 camping trip. He was also convicted of an attempted murder charge while he was serving time in the Shasta County Jail.

The high court says an expert was wrongly not allowed to testify during Smith's murder trial. The jury was told of Smith's several attempts to escape from jail and his violent attitude towards guards. A prison expert was barred from telling the jury that security is tighter at San Quentin State Prison.

A decade ago, Smith's attorney Jeffrey Jens described his client as someone who does not deserve a death sentence.

"He was raped by his father over and over again. He was neglected, abandoned, abused and then shuffled into the system. He never really had a chance. He has a brain dysfunction. This is not the kind of person that you put to death, this is the kind of person that gets life without parole," Jens shared during Smith's murder trial.

On June 22, 2002, Smith and inmate Benjamin Williams carried out a plan to kill correctional officer Timothy Renault.

On Monday, Renault shared his reaction, saying he is surprised to hear Smith's sentence was overturned.

"It was decided that the proper punishment for all these crimes and the safest place for him and the community for the inmates and correctional staff was death row and for that to be dropped, it's mind-boggling to me," Renault said.

Smith and Williams used a weapon made out of a shower grate to brutally attack Renault, leaving him on the jail bathroom floor to die.

"A lot of thoughts go through your head, but hoping to keep going and hoping that help would get there and eventually it did," Renault shared.

Fellow Officer Boun came to find Renault and immediately took action to save his life. The two now work together for the patrol division at the Redding Police Department.

"Boun and I are very close. When that happened something just clicked between us," Renault said.

Boun and Renault took the stand in Smith's trial. Renault said Smith is a dangerous man who is willing to take more lives.

"He's a very violent person, he enjoyed assaulting anyone he could, like I said, whether it was correctional staff or inmates," Renault said.

Monday's ruling will keep Smith alive in prison as he could face another penalty trial or may be sentenced to life in prison. Renault is grateful to be alive himself.

"I knew what I wanted to do with my life, and obviously I wasn't done and I didn't want these guys to win," Renault explained.

It took 16 months for Renault to fully recover from the attack. Soon after, he started his career as a police officer and was sworn in by his brother.

"For everybody who would say, 'he was not going to recover, he's not going to be a police officer,' just pushed me further," Renault said. "I enjoy my job every day and living in the community. It makes you want to work even harder to keep it the place that we all love."

Very disturbing, prolonged death. Sad. I was trying to recall another murder that included such psychological torture.
