It should be then at least it would be on the table as reasoning for how got something done. Not like it being illegal makes it undone...there is a million ways around it and all it did was spawn a shitload of ways around it and bureaucratic legislation to try to curb people from doing it!

reminds me a bit of the should drugs be legalised and taxed by the government in order to make it more regulated and thus taken away from gang crime argument

Exactly in a free choice society it is damn near impossible to rule out actions of the individual without a major withholding of civil liberties!

I think it's a little different in that some people can't afford bribes, at least not in the amounts others can. It would basically just allow people with more wealth to control more. Don't they do that anyway?
