The ny times, the Wall Street journal, endless other sources. The number is actually 97% for federal cases, and 94% for state level cases. So it could also be stated that this would be the conviction rates as well. You're right, with a public defender OJ would have been found guilty, but regardless of his actual guilt or innocence. The public defender would have probably tried to plead down from Capitol punishment to life without parole. Innocent people get convicted every day Are you going to take the deal and serve 2 years, or take your chances against a 95% conviction rate and possibly get far longer? |

Plea bargains are so high because of the legal blackmailing system. You plea out, you get X amount of time. You take it to trial you not get X amount, but Y and Z equivalent stacked on top. Plea bargains are a fear tactic that sends innocent people to prison. Especially for those who cant afford counsel. Hell, it is usually the public defenders advising their assigned clients to plea out, before they themselves even investigate the case. It is a sad system. |
