Looks like there was a legislative gap that needed to be closed , there; many other countries in the world are dealing with the very same issue, but IMO new laws will never have the ability to cover everything in the web, as everything changes too frequently, too quickly and too deeply; much better to work on the improvement/update of some already-existing laws, though it's not always possible. For example, the man from Malmö: had it happened in Italy, even ten years ago, that would have resulted in two different crimes; violation of privacy (no matter how the uploader came in possession of the images, sharing them was the first crime itself) and Blackmail, (extortion of money), and only for this second crime one would face up to ten years in prison and fined with up to 4.000 €. However, Italy is still updating its penal code, as new phenomena emerge on daily basis, with very serious issues especially with minors: so in May 2017 they approved a new law to address cyberbullying, in order to punish in a stronger way all those who use the Internet to offend, threaten, abuse, blackmail, denigrate, and steal the identity of minors; this should work, but stricter laws aren't always the answer... |
