Police Charge 90-year-old Man, 2 Pastors with Feeding Homeless
http://www.local10.com/news/police-c...eless/29510268 FORT LAUDERDALE, Fla.- Fort Lauderdale police charged three men -- including two pastors and a 90-year-old man -- for feeding the homeless in public on Sunday, the first such cases made by the city after the a new ordinance effectively banning public food sharings took effect Friday.
The first to be charged was homeless advocate Arnold Abbott, 90, who has been feeding the homeless in Fort Lauderdale for more than 20 years. Also cited were two Christian ministers -- Dwayne Black, pastor of The Sanctuary Church in Fort Lauderdale, and Mark Sims of St. Mary Magdalene Episcopal Church in Coral Springs. All three men face up to 60 days in jail and a $500 fine. "One of the police officers said, 'Drop that plate right now,' as if I were carrying a weapon," said Abbott, who runs a nonprofit group called Love Thy Neighbor, Inc. "It's man's inhumanity to man is all it is." In 1999, the city tried to stop Abbott from feeding the homeless on Fort Lauderdale Beach, prompting a lawsuit from Abbott, which he won. Now he said he will fight the municipal ordinance charge and be forced to take the city back to court. "I’m going to have to go to court again and sue the city of Fort Lauderdale -- a beautiful city," said Abbott. "These are the poorest of the poor, they have nothing, they don't have a roof over their heads. How do you turn them away?" Abbott said he won't turn them away and is planning to bring food to the beach this Wednesday evening with the expectation that he may be hit with another charge. "I don't do things to purposefully aggravate the situation," said Abbott. "I'm trying to work with the city. Any human has the right to help his fellow man." |

This is one of those no win situations that police are put in by politicians. No matter how they arrested the old man, they're going to look idiotic...it's a bad situation all around. In a situation like this one, the chief of police should have personally performed the arrest and booking. The officers should have been wearing regular class A patrol uniforms...not assault vests. And the arrest and/or citation should have been done as quickly and quietly as possible...like at the old guy's house the following day and without the media present. The chief should have been a leader on this arrest and taken all the heat and bad publicity not his rank and file officers. They didn't really need to actually arrest and book the old guy...they knew the old guy from prior arrests/citations. Just run a CII/Rap sheet on the old guy prior to contacting him. If he's clear, then just write the guy a misdemeanor citation and walk away...hell, you could even pre-write the citation and just hand it to him to sign with minimal conversation. What boobs. This is a very simple case that the old guy has already sued and won once already...why let some politician push the police into looking stupid. The chief of police needed to deal with this personally...not his officers and not on TV. Bad move and piss poor tactics.

It makes sense that they wouldnt want people feeding the homeless in tourist areas like at the beach, and why they wouldnt want them camping out down there too. Its a city that thrives off its beaches. Would you want to go on vacation only to see homeless people harassing you for money all the time? I know it annoys me when the homeless come asking for change. Additionally, this man is not following the law. If he wants an organization dedicated to the passing out of food to the homeless, then all he has to do is apply for a permit, and do so in a designated area. |

No matter what you say against helping the homeless/transients you sound like an asshole, but they do bring many problems into a community when large numbers are present. There probably isn't a city in the Western World that doesn't have some form of municipal restrictions or laws targeting/discouraging homeless/transients...so everyone straighten out you panties and stop sounding so self righteous, every civilized country does this...just not usually so ham handedly. No matter what you think about the homeless/transient community you need to realize that they bring some very real and dangerous problems with them and are a drain on a community's resources (police, fire, hospital, parks, community areas, businesses, property values, quality of life, etc.) and contribute to a community's property values and resale values on homes and businesses. This sweat little old man has an agenda and is a little rebel rouser who needs his arrest to civilly sue the city. He doesn't want to go through the outlined steps to obtain a permit as required by law...because he thinks he's above the law because he's doing God's work by feeding the downtrodden and no government entity has authority over his charity and good works...bla bla bla. Let's look at this issue from the city's point of view. What if this sweat little old man was preparing his free food in an unsanitary way? What if he was actually unintentionally poisoning the hobos and bums that he was trying to help? What if someone actually died as a result of his food? Who would the hobo's family blame...especially if the sweat little old man was feeding folks on city land and it was shown the city had knowledge that this was going on and failed to take action to enforce the law? Who has more money? The church? The sweat little old man? The city? You can figure out who gonna pay for this. If you think for one second that some asshole ambulance chasing lawyer wouldn't jump on that and sue the city you'er either delusional and/or very very naieve.
