A former high-school teacher has been released after his 30-day prison sentence for raping a teenage student.

Stacey Rambold, 54, left the Montana State Prison in Deer Lodge, where he served his term for the 2007 rape of Cherice Moralez in Billings.

Cherice committed suicide in 2010 before Rambold went to trial.

State officials say Rambold must register as a sex offender and will remain on probation as prosecutors appeal the case to the Supreme Court.

They hope to win a longer sentence and send him back to prison.

The original sentence has drawn protests for being too lenient, and sparked an outcry after the judge in the case made comments that appeared to pin some of the blame on the girl.

Judge G Todd Baugh described Cherice as "older than her chronological age".

The girl's mother, Auliea Hanlon, said Rambold's actions were a "major factor" in Cherice's suicide, saying she was ridiculed by her peers after details in the case became public.

Speaking ahead of the man's release, Ms Hanlon said: "I figured he'd be fired, go to jail, and she would be vindicated, and that would be the end of it.

"Instead, here it is six years later, still going on, and he's getting out," she said.

Rambold's lawyer Jay Lansing described his client as a one-time offender with no prior record who took responsibility for his actions.

My brother used to joke, "If she smells like pee, she is too young, " but, he'd never rape anyone.

This is fucked up. If the judge thinks it's legal for an adult to have sex with someone who looks like an adult, regardless of their actual age, does that make it illegal for an adult to have sex with an adult who looks too young? Seems like his logic is just messed up. Disbar!

Judge is toast--soon and the rapist is in for a lot of shit . Barry Beach will get paroled I hope, at least that is the way it sounds. Bad thing is our governor is big time pro law enforcement so he's a big speed bump in Barry's road but there doing an end run around him by petitioning for parole, I don't think the gov. can stop that.

I have seen Barry on tv so many times, I feel like I know him

He was released, got a job, a place to live, did well, and he was sent back again

I've signed everything his team sends me. I feel really bad for him.

I realize there are many people stuck in his situation, but, most guilty people released for a short time after so many years in jail would have recommitted by the time Barry was sent back.

His case and Ray Krone's were all over the tv and news. Ray now works with, The Innocent Project, which I'm sure you already know.

He got a complete makeover and is doing well.

Had they been in Texas, they both probably would have been killed like Cameron Todd Willingham

Cameron would have been found innocent, or at the very least, granted a new trial, two months after he was executed due to changes in forensic testing of fires.

Oh yeah the woman who got released shoved her new husband off a cliff in Glacier Park , that was the feds that let her go, don't believe they have much of a case is why.

I think she'll be put in jail sooner or later.

There are several of those kinds of cases. I can't recall anyone getting away with that one.

Not this case, but, I live in Filthydelphia, PA, and it pisses me off royally when someone arrested, usually for murder, has 30 pages of arrests for weapons, drugs, assault, etc.

No one saw a pattern since age 15?!?
