This happens very often here too, during wild boars hunting: but almost always one gets charged with "culpable homicide" through wrongful conduct, since you shouldn't shoot from a .270-caliber just because you "saw movement in the brush", and since there could be some human being behind that bush.

Yes, that's the part I don't understand: though it "appeared to be accidental", I find it very strange that one is free to shoot at anything that moves behind a bush without having a clue what is it. Also, i guess it's hard to explain to the relatives of the victim: "eh, he was mistaken for a bear". |

I would much rather the gun had backfired and killed the hunter. I will never ever understand the need to go out shooting and killing bears. Or any other wildlife.
