In a truly bizarre case of free speech versus privacy rights, a spurned New Mexico man has been sued for putting up a billboard that revealed his unnamed ex-girlfriend had an abortion.

The 35-year-old man, identified as Greg Fultz, posted his sign on Alamogordo’s main thoroughfare. The billboard shows Fultz holding in his arms the outline of an infant. The text reads: “This Would Have Been A Picture Of My 2-Month Old Baby If The Mother Had Decided To Not KILL Our Child!”


In what had to be a most expected volley, Fultz’s ex-girlfriend sued him for harassment and violation of privacy, and a domestic court official recommended the billboard be removed, according to the AP.

But Fultz’s attorney argues the order violates his client’s free speech rights.
“As distasteful and offensive as the sign may be to some, for over 200 years in this country the First Amendment protects distasteful and offensive speech,” Todd Holmes said.

The woman’s friends say she had a miscarriage, not an abortion, according to a report in the Albuquerque Journal.

Holmes disputes that, saying his case is based on the accuracy of his client’s statement.

“My argument is: What Fultz said is the truth,” Holmes said.

As for the sponsors at the bottom of the ad, Right to Life New Mexico initially agreed to endorse the billboard but has since requested its name be removed from the billboard. RTLNM President Betty Eichenseer said “[A]s the situation and time went on we received additional information from others that it no longer seemed in the best interest of Right to Life to participate in the billboard.”

So who is N.A.N.I., the National Association of Needed Information? That’s a group, created by Fultz, which plays off the unnamed woman’s first name.

according to american law, what sort of legal ramifications does that have? will he get done for perverting the course of justice considering he's made false allegations on the board which led to a load of wasted court time, or what happens now?

Not sure. They had said the case went to civil court and not criminal so he will probably end up paying his ex and the court fees with little or no jail time. It is being handled as a domestic.

this is the town i live in. the guy who put up the bill board is the guy who does my company website. the girl is best friends with my niece. both are nice people who have gone too far to hurt each other. i hope it ends soon.

i also graduated with the lawyer handling his case. it will be a slam dunk for him. they have also painted over the naming part of the billboard but it is still up as of today. it is actually located 1 block south of my office. if i think about it i will post a pic of it.

just like i've said...if you are doing things that you wouldn't like to be advertise on BILLBOARDS then it might not be a great idea...the idea of PRIVACY vanished in the 70's...it is very hard to have PRIVACY these days...thinks of all the web cams that are hacked into...and all the cameras on the street corners and elevators and everywhere else you turn...and like candymosh said...how many ppl really knew what girl they were talking about...that guy didn't look like much of a winner to begin with...
