Joseph Oberhansley: Man Accused Of Killing His Ex-Girlfriend So He Could Eat Her Brain And Organs Now Faces Rape Charges May 5, 2015 Rape charges have been added to the case against the 'Indiana Cannibal.' Joseph Oberhansley, 34, now faces a rape charge on top of the other charges connected to the stabbing and death of his girlfriend Tammy Jo Blanton, 46. According to the Daily Mail, Oberhansley broke into Blanton’s home stabbed her to death, then ate her intestines. The rape charge was added in court on Monday, before the judge set a trial date for the Indiana man. The addition of the rape charge could mean that Oberhansley would be eligible for the death penalty, if convicted. In order to get the death penalty, prosecutors must prove that on top of murder that Oberhansley committed rape, burglary, or dismemberment. During his court appearance on Monday, Oberhansley acted erratic. He made several vocal outbursts and spoke over the judge. Oberhansley denied the rape charges,saying that he had too much honor and integrity and that he was, “too handsome,” to have raped his former girlfriend, reports the News and Tribune. When the presiding judge read the rape statue Oberhansley said, “I’ve never seen such bullshit. Excuse my language. They keep falsifying shit’.” Oberhansley also went off on a bizarre tangent about being Lance Armstrong, “the man who, ‘landed on the moon.'” Oberhansley’s trial date has been set for August 2. Between now and then, both prosecutors and defense attorneys will work to gather additional evidence. The later court date was sought by both the prosecution and Oberhansley’s defense attorneys so they can research a previous manslaughter conviction. When Oberhansley was 17, he was found guilty of killing his girlfriend. He was convicted of manslaughter in the 1998 death of his then-girlfriend, 17 year old Sabrina Elder, just days after she gave birth to their son. The state of Utah discharged him from parole on July 23, and on July 31, Blanton posted $500 bond for him on charges of recklessness and resisting arrest stemming from a car chase. On September 11, Tammy Jo Blanton called 911 to report that her ex-boyfriend was outside her home and would not leave. Court documents show that Oberhansley admitted to police that he broke into Blanton’s home, killed her, then ate her heart and parts of her brain and lung. During Monday’s court date, the judge denied Oberhansley’s request to be released from a 23-hour-a-day solitary confinement, so he could join the general population. The judge did however; state that she would have the Clark County Sheriff’s Office review Oberhansley’s place in the jail. Toward the end of the hearing, Oberhansley once again spoke out saying, “This whole thing is completely wrong. It’s preposterous.” |

So he is above rape but not murder and cannibalism? Yea that's a great argument Einstein. How could they prove that he raped her whilst she was alive, what if he had a penchant for a spot of necrophilia...is that still rape |

No, necrophilia is not rape. The way they can tell if she was alive when raped has to do with the amount of histamines present in any vaginal injuries and/or subcutaneous blood or swelling in vaginal (or anal) tissues. You can beat the crap out of a dead person but, because circulation has stopped, they will not bruise, bleed, or swell. |
