I didn't say he *should* sue. I was asking if surviving relatives would be allowed to, because of how sue-happy some people are. I don't think anyone should be allowed to sue over this, because as I said the diner is fairly clear that eating there is bad for your health, and no one should be allowed to sue a restaurant because they ate there and had a health issue.
