If you can say, "I can't breath" like ten times then you can breath.
He's trying to articulate the fact that he's having problems breathing. Think it through if you're on the point of unconscious three simple words to draw attention to this is the best thing to do. It's not his fault those cops were unmitigated fuckwits.

When you decide to resist arrest, you set yousrelf up for potential harn.


Girl a year ago died from resisting arrest. She pulled hard away the cop, landed, cracking the back of her head on a hand rail.



This guy being a fat ass, makes it harder to establish a restraint hold. So the only goto method would be a neck hold.

A good point, but for a civil law suit, not a criminal indictment. Just because he used a compliance hold not authorized by his department/agency doesn't mean he showed an prior criminal intent to kill the bad guy.
I don't think, the cop meant to kill him I just think things got very heated and got out of control a bit. I think they are both at fault. Mr Garner probably should of complied a little better. Then again maybe officer Daniel Pantaleo could showed a little restraint maybe just a little who knows what the out come might have been?

Another thing to do would be stop resisting, and just put your hands behind your back. As long as you're still resisting, they aren't going to let go. If you've ever watched "cops" it's not uncommon for the criminal to complain about being hurt during their resistance.

Technically there was no choke out. The RNC is not an air constricting hold like the guillotine. The RNC involves the squeezing the carotid artery so that the arterial blood supply is slowed down to the brain causing the victim to lose consciousness. It's actually a painless why to go out. The guillotine however is a painful bitch because you're putting heavy pressure on the person's throat, causing a lack of oxygen to the brain..
That's true if you're using proper technique, but this officer had arm slightly in the wrong position. His forearm was compressing the adams apple, if the victim knew any technique he could have just spun out and dropped chin although maybe not with 4 other officers holding him down..

Use of a hammerlock on the arm and step on the back of the knee joint would have been the way I'd have gone with. I'd have to see the autopsy report, but I think the guy died from a swollen trachea due to the choke. He shouldn't have resisted arrest though.
He did, and it was ruled a homicide by the coroner.

The guy did have his hands up when the choke hold was initiated from behind..

This is my view...I know that Mr. Garner resisted arrest, however ...after several times Mr. Garner stated he couldn't breath, he wasn't absolutely no threat to the police officers, at that time the police should have let him up (he was no longer a threat of any kind!!!!!), to top it off the officers' story was inconsistent with the plain as day video, after Mr. Garner repeatedly stated he couldn't breath the pit bull cops should have got off him. Yes he had health problems, that just contributes to the brutality of the situation concerning Mr. Garner.

If you're able to talk, yell, or scream while being choked then you're not being choked...it's kinda a physiological impossibility. I'm probably one of just a handful of DR members who have actually applied a real choke hold to another person in a uncontrolled incident as a police officer. The point of a choke hold commonly used by police is that it shuts the supply of blood off to the brain resulting in the bad guy basically fainting for a few seconds. A choke hold has nothing to do with restricting the flow of air. This fat asshole might have had breathing difficulty breathing because of his weight and the weight of any officers on his back...that would make more sense than the "choking" theory. A well executed (no pun intended here) choke hold is a thing of beauty to behold. No injury, no marks, no issues, just unconscienceness and custody. We used it to great effect in the days of PCP and before Tasers were common issue. You just have to remember that when the bad guy stops moving...relax your hold accordingly.

Look, if you have ever taken First Aid/CPR, you would know that if you can speak, you have enough air to breathe. If a person is choking, they wont even be able to cough, because if they could, it means they have enough air to breathe.

The same rules apply to speaking. If you can speak, you can breathe.
