Then, they use a hypothetical example of forgetting a box of leftover food to forgetting a child? These guys aren't exactly the Gerald Shargel types are they? |

There is such a thing as felony murder, which is defined as murder committed during the course of or arising as a direct result of the commission of a serious crime (i.e. felony). It's considered to be first-degree murder, but differs therefrom in that premeditation and/or the specific intent to kill need not be present for the criteria to be fulfilled. In this case, the primary crime from which the murder arose would be child endangerment or the like, which is indeed a felony itself. My guess is that the prosecution is charging him with felony murder in the hopes of winning a conviction equivalent to first-degree murder even if they're unable to prove premeditation or specific intent. Such a conviction would qualify the defendant for a life sentence or even the death penalty, depending on state law. |
