Police are treating 20-year-old Jose Inez Banda Jr's death as murder, the Houston Chronicle reported.

Banda Jr's Chevrolet Malibu vehicle struck and killed two young brothers near Alvin in Texas. Twelve-year-old David Barajas and his brother, Caleb, 11, were pushing their dad's Ford 250 truck that had run out of fuel just 150 metres from the driveway of their home, FOXNews reported using AP.

"One of the 911 callers reporting the tragic crash that claimed the two young brothers' lives was talking to dispatch when he reported hearing the gunfire," said Dominick Sanders, an investigator for the Brazoria County Sheriff's Office. "This incident has been such a tragedy with so many dynamics involved."

The brothers were buried yesterday and remembered at a funeral service as being inseparable siblings who loved football.

The Brazoria County sheriff's office says investigators did not have "formal suspects" in the case but that they haven't interviewed the boys' father, David Barajas Sr. or mother, Cindy Barajas, who was in the pickup truck. The boys' father was injured in the crash.
