On January 30, George Alan Kelly, 73 shot and killed 48-year-old Gabriel Cuen-Butimea after he crossed illegally onto his ranch in Kino Springs, near Nogales.





Kelly, who friends say has had trouble with other migrants passing through his land, remains in custody in Arizona on a $1million bond.





He pleaded with a judge to lower it or set him free earlier this week, citing the fact that his elderly wife couldn't tend to their livestock alone, but he was sent back to jail.

Cuen-Butimea tried multiple times to enter the US illegally before Kelly shot him dead. Records indicate he was deported several times, most recently in 2016.




It's unclear if he ever crossed the border onto Kelly's property before the incident on Monday.

Once someone has been deported, the US government bars them from re-entering the country for five or 10 years, and repeat offenders are banned for longer or permanently depending on the reason for deportation.

A resident of Kino Springs stated that it wasn’t unusual to see people coming and going across the border.

Many of the details of the case remain unclear, including whether Kelly will be able to invoke a stand your ground defense.

As Kelly awaits his next court appearance, Cuen-Butimea's family in Mexico are mourning his death and demanding justice.

Dude is illegally coming over here and trespassing on land on top of it? Plenty of folks would shoot anyone trespassing on their land.

Trespassing is dangerous business in the states. Idiot died by his own mistakes. Guy should be released/pardoned/discharged for protecting his property.

As long as the property owner posted his property with the standard "No Trespassing - violators will be met with deadly force" signs (in several languages, of course), then he should be good to go.

I wonder if the AZ Stand Your Ground law could be used in the case.

I think AZ Revised Statutes give the property owner the OK to light up someone if they feel threatened with bodily harm. I'm too lazy to look it up.

I did some checking and unless Cuen-Butimea posed as an imminent threat, the statute does not hold water.

Which is most likely why he was arrested.

Hopefully, with the almost $220k raised, he'll have a kick ass defense attorney.

I totally back him as I've also had to shoot at border jumpers too... only difference is that I live in Canada!
