Well... Honestly... He was attacked with a deadly weapon (skateboard)... He had every right to use deadly force... I don't know. Mofo shouldn't a been involved in that to begin with idk&idgaf Glad no one died :D |

In every state I've lived smacking someone in the head with a blunt object is a serious felony. The man being attacked had every right to use deadly force if he was getting clubbed.

I’m not sure about New Mexico, but here in Texas if you initiate even a verbal argument that ability to respond with deadly force goes out the window. HOWEVER, you get that ability to defend yourself back if you flee, or in this case made a reasonable effort to flee, the altercation you started in the first place. So, I give the shooter 50/50 odds. As the prosecutor, I would ask ‘why the hell did you insert yourself into a demonstration like that?’ As his defense I would point to the fact that he quite clearly tried to get out of the situation once it turned ugly. |
