New York State labor laws do not contain mandates requiring a minimum number of employees on-site for retail or food service businesses. Once an employee is 16, they can legally operate a cash register, handle food, and close a shop by themselves. For minors aged 16 and 17, New York law allows them to work up to 4 hours on a school day and up to 28 hours per week when school is in session. Because the incident took place in the evening, her presence at the shop fell well within legal hours. Labor laws strictly prohibit 16-year-olds from operating hazardous machinery, like commercial dough mixers or power cutters. However, working a standard counter, taking orders, and assembling pizzas are classified as safe, permissible tasks. However, they may not drive between 9:00 PM and 5:00 AM, unless driving directly between home and work or an official school course or buy a beer or purchase a scratch-off lottery ticket, get a tattoo, vote or join the army. |

Thank you, I didn't know this (obviously) and I appreciate you taking the time to explain it. I wouldn't admit this in court, but I am guilty of not engaging my brain long enough to realize that the laws here aren't universal in the other states. |
