Good point. If the person with the dashcam turns it over to the cops (I sure as heck would not. More on that in a minute) and charges are filed, it's a very questionable self defense argument. He could have just driven over the curb and left before the beat down.
I've said this many times, you have to be out of your mind to get out of your car and act the agressor. EVERYONE carries a gun today or what if it's an NFL lineman size guy or a Hell's Angel who would be happy to pound your face into mush.
As far as the dash cam is concerned, if I watched this go down I would have chalked it up as "you fucked around and found out". If it was the other way around and the baseball bat guy prevailed, I likely would have ratted him out because he was the agressor.
