NYPD: Kenneth Moreno, Franklin Mata Surveillance Tape & 911 Call
A 911 call and a surveillance video was admitted as evidence during the trial of NYPD officer Kenneth Moreno and Franklin Mata who are accused of raping a woman in the East Village. The high-profile court case that captivated New York City, former NYPD officers Kenneth Moreno and Franklin Mata were acquitted of rape charges but found guilty of official misconduct. The verdict, delivered in 2011, stemmed from an incident in December 2008, when the officers were called to assist a drunken woman in Manhattan's East Village. Moreno and Mata, who were on duty at the time, helped the intoxicated 27-year-old woman into her apartment. Prosecutors alleged that Moreno raped the woman while she was under the influence of alcohol and unable to give consent, with Mata acting as a lookout. The defense argued that Moreno did not have sexual intercourse with the woman but merely cuddled with her to provide comfort. The case hinged on a secretly recorded conversation in which Moreno admitted to wearing a condom but later clarified he was trying to appease the woman, who confronted him after the incident. The lack of physical evidence of rape played a significant role in the acquittal. However, the jury convicted both Moreno and Mata of official misconduct for entering the woman's apartment several times without notifying their superiors or taking proper police action. This conviction underscored the breach of NYPD protocol and the officers' failure to uphold their duties. |

Re: NYPD: Kenneth Moreno, Franklin Mata Surveillance Tape & 911 Call
Making a bogus 911 call IS a crime. And although there is apparently not enough evidence to convict for rape, there's plenty to indicate that these cops were in violation of just about every rule of professional and ethical behavior.
